The EEA does not give appropriate population estimations. It did not consider impact on bats. Birds treated incompletely, with mistakes in defining the threats or declared lack of impact. Report on Environmental Impact on Natura 2000 points out significant influence and demands compensations. The decision on environmental conditioning has been issued. Public consultation - practically none.

Details of the case
The Report on environmental impact for the investment in question proposed two variants – West and East option. The Western option does not disturb Natura 2000 sites, while the Eastern option enchroaches upon two Natura 2000 sites: PLB Grądy odrzańskie and PLH Grądy w Dolinie Odry. According to the EU Comission guidelines and verdicts of the Court of Justice of the European Communities, priority should be given to the option avoiding conflicts with Natura 2000 sites. Despite these requirements the Eastern option was chosen, decision based on the multi-criterion analysis. The Environmental Impact assessment for natural environment was not done for the Eastern option. Assessment of impact on the subject of Natura 2000 protection for both of the sites revealed significant influence on the habitats and birds for protection of which the sites were created.
